Repossession is a painful and sometimes embarrassing situation. At Cartel Client Review we understand that the problems leading to repossession are often the
result of a low point in our clients’ lives; an element of bad luck or a time when circumstances conspire to mean that good and honest
people simply fall behind in their mortgage repayments.

Repossession Unwind Claims
If you have been previously subjected to a repossession we may be able to assist you in a claim for compensation.
The repossession unwind is a two stage process. The first stage is to pursue a claim for contract irregularities relating to the mortgage
involved.
If this results in a successful claim we would then progress to the second stage and look to claim against what may have been, in effect, a
wrongful repossession.
How do we do this?
The following example is both fictitious and simplified to help you understand the underlying principles of a repossession unwind.
Home was repossessed due to £6000 arrears.
Claim on the basis of irregularities within the mortgage contract results in a payment of £8000. This represents a loss of £8000 as a result of the
contract.
If the irregularity claim had been resolved at the time of repossession the client would still have received £8000 and could have paid the £6000 arrears.
The repossession therefore would not have taken place.
In effect, the client was repossessed for a debt of £6000 when the mortgage lender ‘owed’ the client £8000.

Review
A Cartel Client Review representative in your local area will introduce you to our repossession unwind service and explain how Cartel Client
Review may be able to help you claim compensation due to potential contract irregularities within the mortgage contract at the time of repossession.
The representative will ask you for basic details of the mortgage or other loan that led to the repossesion and introduce you to other Cartel
services that may be relevant to you. Each potential claim will be entered onto our bespoke IT system by your representative. No payment is required
at this stage and you are under no obligation.

Underwriting (Vetting)
Our internal underwriting (vetting) department will assess each of the submitted applications. Where underwriting (vetting) believe there is a
reasonable chance of a successful claim against the mortgage or loan provider a ‘yes’ decision will be made. Where underwriting (vetting)
believe that a successful claim is unlikely a ‘no’ decision will be made. On occasion a ‘possible’ decision may be returned.
This often means that there is not enough information about the contract to be able to make a firm assessment at this stage and sight of the
information held by the lender is required before a final assessment can be made.

Instruction
Our representative will meet with you at time and place of your convenience. It is the representative’s job to ensure that you understand exactly
how we work and take you step by step through the paperwork. You decide which products you wish to proceed with.
The cost of each stage of a repossession unwind Client Review is £495, which is refundable should your case be unsuccessful (subject to Terms and
Conditions).

Investigation
In accordance with the provisions of the Data Protection Act, our processing team will now contact the lender to obtain your ‘client file
’, including the contract / agreement relating to the loan. Where the lender does not comply, an offence is committed and our solicitors will
use the full power of the law to obtain this file.

Solicitor (Stage 1)
With the ‘client file’ in, a further assessment of your case will be made and a specialist solicitor will be assigned. Your solicitor
will build a case, based around contract irregularities, with the 1st stage of the claim being to prove irregularities in the contract at the time of
repossession and claim compensation for this. While many cases are expected to be settled ‘outside of court’, should the need arise to
take the lender to court, our solicitors will purchase, at their cost, a legal expenses insurance policy and obtain expert barrister's opinion where
required.

Payment of Mortgage Claim
In the event of a successful claim, you will receive 100% of any compensation awarded.

Solicitor (Stage 2)
Your solicitor will now look to demonstrate that, when the contract irregularities previously proven are considered, the repossession should
not have taken place. Your solicitor will do all they can to gain the maximum level of compensation for you. A success fee of 5% of the total amount
received and/or written off by the provider will be payable. You will receive a cheque for the remaining amount.
